What Is A Good Reason For Getting Laid Off Or Fired?

 
Before firing someone, an employer should show a legitimate reason for letting an employee go. Some valid reasons for termination include misconduct at work, not performing tasks required for the position, harassment of others, and insubordination.

An employer is not allowed to terminate the employee solely based on a discrimination issue. A discrimination issue can include gender, disability, race or nationality, creed, disability, contrary beliefs, and a variety of other discriminatory reasons. Discrimination laws should be researched to check if the specific type of discrimination is protected by law. Can my boss fire me without giving prior notice?
Employees who are considered to be working at-will can be fired without notification.  Exceptions to this rule include:
  • If an employment contract has been signed, then employers may be required to give some sort of notice.
  • If a union member is covered by a collective bargaining agreement.
  • The WARN Act may also protect employees as it requires employers to provide a warning to workers prior to production plant closings or a large number of lay-offs.
  • There are also various federal laws and state specific laws that may protect employees who have been fired.
Can my boss fire me as a form of retaliation for whistle blowing or for filing a worker’s compensation claim?
